Terms of Use of the Alila Website

1. General. The owner of this website is Alila Limited, an Irish company No. 443881, located at Alila Corporate Head Office, 41 Drury Street, Dublin 2, Ireland (“Alila”). By using this website you agree to be legally bound by and act in accordance with these Terms of Use and by all other applicable provisions; in particular you agree not to do the acts prohibited under paragraphs 3 to 5 below. If you disagree with these Terms of Use and/or with any other of the applicable provisions, you are not permitted to, and agree not to, use this website. 

2. Exclusive distribution channel. This website and the Alila call centre are the exclusive distribution channels of Alila’s services. Alila.ie is the only website authorised to sell Alila merchandise, whether on their own or as part of a package. Alila does not authorise any other websites to sell its merchandise. Alila therefore reserves the right to cancel any purchases made other than directly through Alila.ie, including any purchases made through third party websites.

3. Permitted use. You are not permitted to use this website other than for the following, private, non- commercial purposes: (i) viewing this website; (ii) making purchases; (iii) reviewing/changing purchases; (iv) transferring to other websites through links provided on this website; and (vii) making use of other facilities that may be provided on the website, use of any automated system or software to extract data from this website or the www.Alila.ie website for commercial purposes (“screen scraping” and price comparison searches) is prohibited.

4. Intellectual property. All information, data and materials presented on this website, including names, logos, merchandise, prices, etc., as well as the colour scheme and the layout of the website, are subject to copyright, trade mark rights, database rights and/or other intellectual property rights. You may use this information, data, materials and the colour scheme and the layout of this website only as strictly required for your permitted personal, non-commercial purposes described in paragraph 3 above. Any other use and/or reproduction of the information, data, materials, or of the colour scheme, or of the layout of the website, without prior written consent of Alila, is prohibited and will constitute a breach of these terms and conditions and may infringe Alila’s intellectual property rights,. Alila reserves its right to take such action as it considers necessary, including issuing legal proceedings without further notice to you, in relation to any unauthorised use of this website. 

5. Links to this website. You may not establish and/or operate links to this website without the prior written consent of Alila. Such consent may be withdrawn at any time at Alila’s own discretion. 

6. Limited liability. Alila will not be held liable for any losses and/or damages arising from the use of this website or of any other website to which this website provides a link, and/or from the use of information presented on this or any such other website. 

7. Applicable law and jurisdiction. It is a condition precedent to the use of the Alila website, including access to information relating to merchandise details, costs etc., that any such party submits to the sole and exclusive jurisdiction of the Courts of the Republic of Ireland and to the application of the law in that jurisdiction, including any party accessing such information or facilities on their own behalf or on behalf of others.

In the absolute and sole discretion of Alila, a legal action may be brought by Alila against any party in breach of these terms and conditions, at its election, in Ireland or the place of breach or the domicile of that party, and, if more than one party, in the domicile of any one of those parties, and all other parties shall submit to that jurisdiction.
